How we get the personal information and why we have it

When you access and use our website or contact us via the contact details provided in the ‘Contacting Us’ section of our website, we may process your personal data that you provide for the purposes of responding to queries.

  1. Consultation

In preparation for the application for a Development Consent Order (DCO) and as part of the wider consultation around the Whitestone Solar Farm Project (“the Project”), we will collect any information that you provide to us as part of engaging with the consultation. We have a statutory obligation to identify and collect details of all parties holding a legal interest in the relevant land or property affected by the proposed development plans. We may therefore get in touch with you and ask you to provide us some details in relation to the interest that you may have in the land and/or the property, including personal data as explained further below. For this purpose, we have engaged third party consultants who will assist us with collating the relevant information.

In addition, as part of our consultation and engagement, we seek your views and the responses you provide will help shape our development proposals and they may be referenced in the DCO application documents that we submit to the Planning Inspectorate.

The type of personal information we collect and what we use it for

We may collect (including via instructing our third-party consultants) and process the following information:

  • Your name
  • Your email address
  • Your contact number
  • Your home address
  • Your address for service of notice (if different)
  • Any other personal data that you give us in correspondence
  • Any comments and feedback you provide as part of our consultation
  • Any details in relation to your interest in the relevant land or property and current status of sale or offers on that land or property (i.e. leasehold, freehold, tenant, rights, easements or other legal interests)
  • Managing/letting agents’ details

We do not typically collect or process any sensitive or special category information.

We use your personal data to:

  • Respond to queries and correspondence you send to us.
  • Run the consultation process in connection with the Project and inform you of updates relating to the Project.
  • Comply with statutory obligations in connection with the Project, including referencing information provided to us in our DCO application submission.

How we store your personal information and who we share it with

We will hold this information securely and only for as long as we need it. Sometimes we may need to share your information, but we will only do so where we have a valid legal basis to do so. We will only share the minimum information required for each circumstance.

In particular, we may share some of your personal information with our group companies and our trusted third parties such as third party consultants and partners in connection with the consultation, the statutory DCO process and the Project. If you engage in the consultation or provide information about your interest in relevant land or property, this information will also be shared with the Planning Inspectorate, and the Secretary of State. This information may also be made publicly available where this is required in relation to the statutory DCO process where necessary to comply with requirements relating to application documents under the Planning Act 2008.

What are the legal bases for using your personal data

When we collect and use your personal data, we rely on the following legal bases:

  • Legal obligationthis means that we have a statutory obligation, as part of the land referencing and wider consultation in relation to the Project, to identify and consult with all the parties who have a legal interest in the land and/or property that may be affected by the proposed development plans as well, where relevant, consulting the local community and potentially affected persons and evidencing that we have had due regard to representations made; and
  • Legitimate interests this means that we have a legitimate business interest in identifying and consulting with all parties who may be affected by the Project to ensure proper planning, stakeholder engagement, and transparent decision-making throughout the development process. We also have a legitimate business interest in ensuring your queries and correspondence you send to us are dealt with promptly and appropriately.

Your data protection rights

Under data protection law, you have a number of rights to control what and how personal data is used, including:

Your right of access – You have the right to ask us for copies of your personal information.

Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing – You have the right to object to the processing of your personal information in certain circumstances.

Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
